In French law, several texts govern the use of computer controls (“PC check”) and requests for deletion of recordings (such as audio or video recordings). There is not necessarily a single article of law that formally prohibits a “PC check” or the deletion of a recording without reason, but several legal principles prohibit these practices in the absence of a clear legal basis. Here's what you can remember:
1. Checking the contents of a computer (“PC check”)
The principle: attack on privacy and individual freedom.
Article 9 of the Civil Code:
“Everyone has the right to respect for their private life. »
Article 8 of the European Convention on Human Rights (ECHR):
“Everyone has the right to respect for their private and family life, their home and their correspondence. »
Penal Code – Article 226-1:
“The act, by means of any means, of deliberately infringing on the privacy of another's private life is punishable by one year's imprisonment and a fine of 45,000 euros […]”
Access to a computer without authorization = criminal offense:
Article 323-1 of the Penal Code:
“Fraudulently accessing or remaining in all or part of an automated data processing system is punishable by two years' imprisonment and a fine of €60,000. »
2. Ask to delete a recording for no reason
Legal registration:
In France, recording a conversation (audio or video) between people present is allowed if you participate yourself.
Cass. crim., January 31, 2007, no. 06-84.009: the recording in which a person participates is admissible in court even without consent of others.
Delete a recording without reason:
Article 432-4 of the Penal Code (abuse of authority):
Prohibits a public authority or agent from abusing their power to force someone to do or not do something.
Article 434-4 of the Penal Code (witness tampering):
“The fact of using threats, promises, pressure, maneuvers or artifices to determine […] to modify one's declaration […] is punishable. »

- Article 9 du Code civil : respect de la vie privée, mais ne s’applique pas contre toi si tu enregistres un contexte où tu es toi-même présent.
- Article 432-4 du Code pénal : interdit à une personne dépositaire de l’autorité publique de contraindre quelqu’un à faire ou ne pas faire quelque chose sans base légale.
- Liberté d’information et de preuve : protégée par la jurisprudence française, surtout dans un contexte où la fonction replay peut permettre de démontrer un abus ou une injustice.
