The towtruck you saw for the one second after you had the collision was the reason for the punishment, but considering that you simply did not see that until you were past it means it would be fair to let you go in my opinion. I will release you pending the decision so you wont have to spend more time in jail incase the decision is in your favor. Of course they also have the right to put you back in jail for it.
