In IRL no one stands in mid of road and then they expect not to get hit by vehicles. U are not valueing ur life. Thats the violation of fearRP.
In my opinion if he gets punishment for VDM u should also get for Fear RP.
Fear RP not only includes gun points at u. it includes situations where u have to avoid scenarios which can lead to ur characters death and standing in mid of the road violates it and shows that u dont care for ur character
The mentioned scenario is just a case of road accident that happened ICly
