Do you know what Mercy Killing is?
According to General Rule 6.13 It is restricted to kill person who is unconscious to help him to avoid RP situation(Mercy killing).
He just finished you, he didn't help you avoid any RP situation.
Mercy Killing is for example of you killed a guy and his friend finished him while he was unconscious so you don't arrest him.
