Athwal, you’re saying “how can you cuff 1st person,” but you’re ignoring how immunity actually works. The leader must have immunity, yes, but wrong use of that immunity leads to punishment
If someone cuffs without knowing he’s 1st person, that’s not a violation, he can be uncuffed once it’s clarified.
And let’s not forget, you were made leader and removed very early but that the separate thing. Also, sharing personal DMs publicly is a clear breach of privacy. Stop targeting others and twisting rules to defend victim, it just exposes double standards.

Furthermore, searching a First Person is illegal without an OI or their explicit consent . The SAHP officer violated these protections by cuffing (detaining) and searching the LSPD Leader before confirming their identity and status, based only on the wearing of a balaclava. Even if the identity was initially unknown, the officer was required to release the Leader immediately upon confirmation of their First Person status. The officer also failed to follow the standard procedure for detaining any state employee, which requires contacting their High Command and the DOJ . Acting contrary to these established procedures constitutes a serious violation. Evidence obtained from the unlawful search is inadmissible

2.1.4 If any Citizen of the State claims to be a First Person or claims they have Full Legal Immunity they must immediately show their Badge/ID in order to prove their Claim. a) If a Citizen does not immediately prove their Claim that they are a First Person when it is required then no provisions of Full Immunity Status will apply and they may be Detained until their Identity and status of Full Legal Immunity is proved.

Claiming to be a 1st person or LEO means nothing, until he has shown a badge/ID. Looking at the Bodycam given, He was wearing a balaclava which is a state issued item for those reasons 2.17.5 would apply. SAHP officer had probable cause to detain him and search him. As no proof of having full immunity was not provided at that time.

1.4.1 Full Legal Immunity applies at all times, regardless of whether the First Person is On-Duty or Off-Duty. a) A First Person is not considered “Always On-Duty” and is only considered On-Duty and obliged to perform their Duties to the State or respond to situations when they are formally On-Duty and therefore expected to perform those Duties.

Claiming that a 1st person is "always on duty" is not true, and are not allowed to carry org stuff while off duty.

Come on, Arthur I honestly don’t know how you got your Lawyer License if this is your assessment of the case. I’ll quote only one article from the Immunity Code, which is more than enough to clarify everything:

2.1.4 If any Citizen of the State claims to be a First Person or claims they have Full Legal Immunity, they must immediately show their Badge/ID in order to prove their claim.
a) If a Citizen does not immediately prove their claim that they are a First Person when it is required, then no provisions of Full Immunity Status will apply, and they may be detained until their identity and status of Full Legal Immunity are proved.

No need for any other articles this one alone makes it clear: Immunity only applies once the identity and status are proven.

The SAHP officer acted completely within the law, as the LSPD Chief was wearing a balaclava in civilian clothing while visiting SAHP HQ. The officer immediately released him once his identity was confirmed. Yet, LSPD Leader continued to abuse his position, flex his immunity and throw insults and even passing illegal revolver to SAHP officer saying I'll see you in Court. He violated Leader Rules and GR 6.4.

And let’s be real what is a leader of a State Organization doing in civilian clothes, wearing a balaclava and carrying state-issued items inside another Department’s HQ knowing that it's against the law? It clearly shows his intentions were not good, but purely to provoke conflict and toxicity.
