The LSPD Leader is a "First Person" and holds Full Legal Immunity . This status prohibits detention or arrest without specific authorization like an Order of Investigation (OI), an Order of Waiver (OW), a Special Warrant of Arrest (SWA), or a direct order from the Governor or Attorney General . Furthermore, searching a First Person is illegal without an OI or their explicit consent . The SAHP officer violated these protections by cuffing (detaining) and searching the LSPD Leader before confirming their identity and status, based only on the wearing of a balaclava. Even if the identity was initially unknown, the officer was required to release the Leader immediately upon confirmation of their First Person status. The officer also failed to follow the standard procedure for detaining any state employee, which requires contacting their High Command and the DOJ . Acting contrary to these established procedures constitutes a serious violation. Evidence obtained from the unlawful search is inadmissible
The SAHP officer acted unlawfully by detaining and searching a First Person without authorization. The LSPD Leader should file a formal complaint with the Department of Justice, providing bodycam evidence, citing violations of the Immunity Code (Unlawful Detention, Unlawful Search) and potentially Arbitrariness.
