I didn't ask what the punishment was in this forum, all i know is he didn't got banned but we think HE DESERVES IT.

This rule needs to be changed. Mute and ban differ according to whom? What is the difference between the person punished with mute and the person punished with ban? It should just be ban or mute. Because admins can make different decisions according to the person.
