According to the basic RP rules if someone pointed the gun at you first and you dont have the gun in your hands or not ready to shoot for some reason, you have to be careful with your ctions and do not pull out a gun like a terminator, this actually called powergaming. and it doesnt matter what you have in your pockets cuz you are unable to use it without dying. i doubt that IRL he would do the same.
